Who is this case for?

Couples starting the family petition process before the green card or immigrant visa stage.

Spouses living abroad

U.S. citizens and lawful permanent residents can petition for a qualifying spouse abroad. Consular processing follows when the case is ready and a visa is available.

Spouses living in the U.S.

Spouses of permanent residents may begin with the petition while waiting for visa availability. Check the USCIS filing charts and your adjustment eligibility first.

TWO PATHS, ONE FIRST STEP

Forms Included in this Application

BEFORE YOU BEGIN

Basic Eligibility Requirements to Petition

Start by confirming the relationship and the petitioner's status. The later green card or visa stage has additional requirements.

Get Started
  • A qualifying petitioner

The petitioning spouse is a U.S. citizen or lawful permanent resident and can document that status.

  • A legally valid marriage

Provide your marriage certificate and evidence that any prior marriages legally ended.

  • Evidence of a genuine relationship

Gather documents that show your shared life, such as joint financial records, housing records, and other relationship evidence.

  • A plan for the next phase

Visa availability, sponsorship, admissibility, and adjustment eligibility are assessed separately. An approved petition alone does not provide immigration status.
