Who is this case for?

First-time applicants

People eligible to request employment authorization or an EAD under a qualifying immigration category. A job offer alone does not establish I-765 eligibility.

Renewal applicants

People who remain eligible and need to renew their EAD. Check the filing window and current rules for your category before the card expires.

    Supporting evidence

Gather identity and immigration records, category-specific notices or documents, required photographs, and a copy of a prior EAD if applicable. Follow the checklist for your specific eligibility category.

    Review USCIS I-765 instructions

Additional documents may apply, such as I-765WS for categories requiring that worksheet, or I-912 if your filing is eligible for a fee waiver. Student categories may require a DSO-endorsed I-20 and, for STEM OPT, an I-983 training plan handled through the school. Review current USCIS instructions before assembling your application.

BEFORE YOU BEGIN

Basic Eligibility Requirements

Employment authorization is category-specific. An EAD does not itself grant immigration status.

Get Started
  • An eligible category

Identify the I-765 category that applies to you. Examples include eligible pending adjustment applicants, certain asylum-related categories, eligible F-1 students, and certain dependent spouses. Each has its own conditions.

  • Proof of eligibility

Provide the required identity, admission, status, and category evidence. A pending immigration case or dependent status does not automatically qualify everyone for an EAD.

  • Correct timing and filing method

Meet the location and filing-window requirements for your category. Confirm whether online filing is available and use the correct fee, any additional required fee, exemption, or eligible waiver procedure.

  • Continued eligibility for renewal

Confirm that your underlying basis remains valid and that you meet the renewal requirements. Filing a renewal does not by itself authorize continued employment after your existing authorization expires.

Check current renewal-extension rules

Do not assume a receipt notice automatically extends your work authorization. For renewals filed on or after October 30, 2025, the general automatic-extension provision for certain EAD categories no longer applies. Separate extensions provided by law or applicable notices may still apply. Review the current DHS rule and the guidance for your category.
