Who is this case for?

People with extraordinary ability or achievement

O-1A covers the sciences, education, business, and athletics. O-1B covers extraordinary ability in the arts or extraordinary achievement in motion pictures and television, with distinct standards for those fields.

A U.S. employer or U.S. agent must petition; a foreign employer may petition through a U.S. agent. You cannot self-petition, although a separate legal entity you own may qualify as a petitioner. O-1 is a temporary work classification.

  • Generally required

    Consultation / advisory opinion

Obtain the opinion from the appropriate peer group, labor organization, or experts. Motion picture and television cases generally require both labor and management consultations. Document any applicable exception or waiver.

Choose the applicable status or visa path

Inside the United States: Change or extension of status

The petitioner requests the appropriate action on I-129 with your status records, prior approvals, and evidence of the proposed work. The principal O-1 worker does not use I-539 for this request.

Check whether USCIS approved both the petition and the requested status action. A new employer generally must obtain approval before you begin work for that employer; filing alone does not provide H-1B-style portability. Review authorized dates, I-94, and any applicable extension rules.

Outside the United States: Visa application and admission

After petition approval, apply for an O-1 visa if required. Petition and visa approval do not guarantee admission; review the I-94 and authorized dates after entry.

  • If a visa is required

    DS-160

Complete the nonimmigrant visa application and follow embassy or consulate instructions for fees, documents, and any interview. Each family member needing a visa completes a separate application.

    Open Fillvisa DS-160
  • As instructed

    Visa supporting documents

Gather passport, DS-160 confirmation, petition approval details, and the employment or engagement evidence requested by the consulate. Check the specific post instructions.

    Review temporary worker visa guidance

O-3 family members

  • If changing or extending O-3

    I-539

Eligible spouses and unmarried children under 21 inside the United States may request O-3 status or an extension. Include I-539A for each co-applicant when required and evidence of the family relationship and principal status.

    Open Fillvisa I-539

Dependents applying abroad generally use DS-160 and the consular process if a visa is required. O-3 status does not authorize employment, so there is no O-3-based I-765 option. Eligible essential support personnel require a separate O-2 petition and are not O-3 dependents.

Supporting payment forms

  • If applicable

    G-1450

Authorize credit card payment for an eligible USCIS paper filing. Follow the payment rules for the particular form and fee.

    Open Fillvisa G-1450
  • If applicable

    G-1650

Authorize ACH payment for an eligible USCIS paper filing. Use the accepted method applicable to the case; both payment authorizations are not needed.

    Open Fillvisa G-1650

Check current editions, fees, filing methods, and instructions before submitting. O-1 has no annual numerical cap or H-1B registration requirement, and does not require an LCA. Fillvisa tools assist preparation; submit filings through the applicable agency process.

BEFORE YOU BEGIN

Basic Eligibility Requirements

Use the standards for your specific O-1 category and document actual proposed work in your field.

Get Started
  • O-1A: Sustained acclaim

Show sustained national or international acclaim and expertise placing you among the small percentage at the top of your field. Evidence may include a major internationally recognized award or at least three of eight regulatory criteria; the overall record must establish eligibility.

  • O-1B: Arts or screen achievement

Arts cases require distinction. Motion picture and television cases use the extraordinary-achievement standard. Submit the qualifying award or nomination evidence, or evidence satisfying at least three of the applicable six criteria, and demonstrate the relevant overall standard.

  • A qualifying petitioner and work

Document the employer or agent arrangement and actual events or activities in your area of ability for the requested period. Contracts, dates, locations, and agent authorizations must support the petition.

  • Consultation and status requirements

Provide the applicable advisory opinions or establish an exception. For a change or extension of status, separately demonstrate eligibility based on your admission and status history. Meeting an evidence count alone does not guarantee approval.
